The Tribunal Resolves to DISMISS the instant election protest, AFFIRM the proclamation of protestee JOSEFINA M. JOSON, and DECLARE her to be the duly elected Representative of the First Legislative District of Nueva Ecija, with a plurality og 6,037 votes over second placer Protestant RENATO V. DIAZ.

The Tribunal Resolved to DENY with finality the Motion for Reconsideration files by Protestant Renato V. Diaz.

The Tribunal deems it inappropriate to render an opinion on the question dealing with the ability or inability of Respondent to discharge his official functions that, as heretofore already so stated, is an issue clearly beyond its jurisdictional authority to pass upon.

The Tribunal Resolved to DISMISS the petition. No special pronouncement on costs.

On 26 October 1998, the Tribunal received Protestee's Manifestation in compliance with Resolution No, 98-1020 of 15 October 1998, stating inter alia, that he is no longer interested in prosecuting his counter-protest and counter-claim, and this, withdraws and abandons the same, in view of the dismissal Protestant's Petition.

The Tribunal rules respondent BENJAMIN S. LIM is a natural-born citizen of the Philippines, within the contemplation of Section 6, Article VI of the 1987 Constitution and, as such, is qualified to continue in office as Member of the House of Representatives representing the Fourth Legilative District of Pangasinan. The petition is DISMISSED for lack of merit, without pronouncement as to cost.

Considering that the Petition of Protest was filed on 28 May 1998, or eleven (11) days after Protestee was proclaimed on 17 May 1998, the Tribunal Resolved to DISMISS the Petition of Protest for having been filed out of time, without procnouncement as to costs.

The Tribunal Resolves to GRANT Protestant's Motion to Withdraw Protest. However, consideration of Protestant' motion to withdraw his cash deposit is, in the meantime, deferred.

Protestee's Motion for Partial Reconsideration is DENIED for lack of merit. However, Protestee's request for the return only the unused cash deposit is GRANTED. as regards the request of Protestant Royeca in his Motion to withdraw protest, for the return of his unused cash deposit, the Tribunal Resolves to GRANT the same.

It appearing that Protestant failed to pay the amount of at least P75,000.00 as cash deposit within the required period, the Tribunal Resolved to DISMISS the instant Petition of Protest for failure to make the required cash deposit as required under Rule 32 (5) in relation to Rule 21 of the 1998 HRET Rules.

Since the protestee was proclaimed on 18 May 1998, the ten (10) day period set forth under Rule 16 of the 1998 HRET Rules for the filing of an electoral protest expired on 28 May 1998. The filing of the petition of protest in 1 June 1998 was beyond the reglementary period and constitutes a ground for the summary dismissal of the petition.

The Tribunal Resolved to: (1) NOTE Protestant's Manifestation filed on 6 July 1998; and (2) DENY his Motion for Reconsideration for having been filed out of time.

The Tribunal further Resolved to NOTE and GRANT the Motion to Withdraw Deposits filed by Protestte on 31 August 1998 considering that the Petition of Protest filed by Protestant has already been withdrawn without any objection from Protestee; and DISMISS the Protestee's Counter-Protest as a logical consequence thereof.
