Nick Bryan C. Patalinghug -v.- Rommel C. Amatong  / 2nd District, Compostela Valley

The Tribunal DECLARES that respondent Rommel C. Amatong had the necessary residence qualification to be elected and to sit as Representative of the Second District, Compostela Valley in the House of Representatives; and accordingly DISMISSES the instant petition for lack of merit.

Jesnar R. Falcon -v,- Florencio C. Garay  / 2nd District Surigao del Sur

The Tribunal CONFIRMS the following Orders of the Chairperson of the Tribunal: Order dated October 3, 2007: (a) GRANTING protestant’s Urgent Motion to Withdraw Protest filed on October 2, 2007; (2) consequently DISMISSING protestee’s counter-protest; and (3) PARTIALLY GRANTING protestant’s motion for the withdrawal of his cash deposit.

Ernesto F, Jaravata -v.- Ma. Amelita C. Villarosa  / Lone District Mindoro Occidental

the Tribunal GRANTS protestant’s Motion for Withdrawal of Election Protest and Motion for Immediate Resolution of Protestant’s Motion for Withdrawal of Election Protest as well as the additional prayer that the ballot boxes from the municipalities of Magsaysay, Mamburao and Sta. Cruz, which are in the custody of the Tribunal, be allowed to be transmitted and delivered to the Commission on Elections where local protest cases involving the mayoralty positions thereof are pending; and as a consequence thereof, protestee’s counter-protest is hereby DISMISSED.  This case is now considered CLOSED and TERMINATED.

There being no compelling reason for the continuance of the proceedings in the remaining 75% protested and counter-protested precincts, the Tribunal DISMISSES the instant election protest and counter-protest.

The Tribunal DISMISSES the election protest for failure of the protestant to pay the required cash deposit within ten (10) days from filing of the protest.  (Rep. Mercado took no part.)

Rainier B. Butalid -v.- Narciso R. Bravo,Jr,  / 2nd District Masbate

The instant election protest is DISMISSED. The Tribunal hereby declares protestee Narciso R. Bravo, Jr. the duly elected Representative of the First District of Masbate with a plurality of Eight Hundred Forty (840) votes over protestant Rainier B Butalid.

Reynolan T. Sales -v.- Roque B. Ablan,Jr.  / 1st District, Ilocos Norte

The Tribunal DISMISSES the instant protest and AFFIRMS the proclamation of protestee Roque R. Ablan, Jr. as the duly elected Representative of the First District of Ilocos Norte, having garnered Fifty-Seven Thousand Eight Hundred Seventeen (57,817) votes over that of protestant Reynolan T. Sales who obtained Fifty-Five Thousand Three Hundred Twenty-Three (55,323) votes of the valid votes cast in the May 14, 2007 elections or a winning margin of Two Thousand Four Hundred Ninety-Four (2,494) votes

Marie Therese U. Veloso -v.- Andres D. Salvacion,Jr.  / 3rd District, Leyte

There is no showing that the officially-proclaimed results of the election which show that protestee had a lead of 1,476 votes, will be substantially affected if the proceedings with respect to the remaining 75% of the protested precincts were continued.

The Tribunal DISMISSES the instant election protest and counter-protest without further proceedings.

Marie Therese U. Veloso -v.- Andres D. Salvacion,Jr.  / 3rd District, Leyte

The Tribunal DISMISSES this ad cautela quo warranto petition considering that the questions of vote-buying and acts of terrorism cannot be considered as proper grounds in these proceedings for quo warranto.

Generoso D. Tulagan,Jr. -v.- Ma. Rachel J. Arenas  / 3rd District Pangasinan

After review of the respective pleadings of the protestants Tulagan and Soriano showing that the matters both raised have already been passed upon in the assailed decision and there being no new valid and meritorious matters raised thereon, the Tribunal DENIES with FINALITY the protestants’ respective Motions for Reconsideration and AFFIRMS its decision dated  November 26, 2009.

The Tribunal DISMISSES the instant petition for lack of merit and declares that respondent ROSENDO S. LABADLABAD is not disqualified as Member of the House of Representatives representing the Second Legislative District of Zamboanga del Norte

Josephine Veronique Lacson-Noel -v.- Alvin S. Sandoval  / Lone District Malabon

The Tribunal hereby declares that protestant Josephine Veronique R. Lacson-Noel is the duly elected Representative of the Lone Legislative District of Malabon City-Navotas in the election held on 14 May 2007, with a winning margin of Five Hundred Forty-Two (542) votes, with the right to assume the duties of her office. Consequently, protestee Alvin Sandoval is hereby declared unseated.

Gallant D. Soriano-v.- Ma. Rachel J. Arenas  / 3rd District Pangasinan

Temogen S. Tulawie -v.- Yusop H. Jikiri  / 1st District Sulu

Records will show that on June 22, 2009, per Registry Return Receipt, the show-cause order was delivered to Atty. Jamar M. Kulayan, counsel for protestant Tulawie.  To date, however, protestant Tulawie has not yet filed his explanation as to why his protest should not be dismissed for lack of interest. The Tribunal DISMISSES protestant Tulawie’s election protest for lack of interest.

The Tribunal DENIES WITH FINALITY protestant Tulawie’s Motion for Reconsideration of Resolution No. 09-114 which dismissed protestant Tulawie’s election protest for lack of interest, for having been filed beyond the ten (10) day reglementary period

Arnel M. Serafica -v.- Ma. Laarni Cayetano  / 1st District Taguig City

The Tribunal GRANTS protestant’s motion  to withdraw protest and CONSIDERS the instant protest case DISMISSED.  Consequently, protestee’s counter-protest and counterclaim filed on June 28, 2007 is likewise  DISMISSED.

Jose Benjamin Benaldo -v.- Rufus Rodriguez  / 2nd District Cagayan de Oro City

After the recount and appreciation of ballots and other evidence in the pilot precincts, as well as the official results in the unrevised precincts, protestee now has a lead of 9,033 votes over protestant Benaldo.  A reduction of a mere 18 votes is not compelling reason to continue with the Tribunal’s judicial review over  this case.  It would be an exercise in futility were we to conduct revision of ballots in other precincts.

The Tribunal DISMISSES the present protest without further proceedings.

James B. Bejarin -v.- Manuel S. Agyao  / Lone District Kalinga Apayao

Results of the election in the protested and counter-protested precincts based on the revision and appreciation of the ballots involved, the numbers indicate that protestee Agyao garnered a total of Twenty Thousand Ninety Two (20,092) votes, or a winning margin of Seven Hundred Ninety (790) votes over the Nineteen Thousand Three Hundred Two (19,302) votes cast in favor of protestant Bejarin. For this reason, protestee Agyao has the plurality of votes to represent the electorate of the Lone District of Kalinga.

The Tribunal hereby DISMISSES this election protest.

Angelito P. Reyes -v.- Henry M. Dueñas,Jr.   / 2nd District Taguig City

The Tribunal GRANTS the instant election protest; ANNULS and SET ASIDE the proclamation of protestee Henry M. Dueñas, Jr.; DECLARES protestant Angelito P. Reyes to be the duly elected Representative of the Second District of Taguig City; and ORDERS protestee Henry M. Dueñas, Jr. to vacate his office.

For lack of cogent reason that exists to warrant a reversal of the Decision, the Tribunal DENIES WITH FINALITY protestee’s Motion for Reconsideration and AFFIRMS the proclamation of  protestant Angelito P. Reyes as the duly elected member of the House of Representatives for the 2nd District of Taguig City.

The Tribunal NOTES protestant's Urgent Omnibus Motion to defer resolution of the Motion for Reconsideration, and DENIES with finality protestant's Motion for Reconsideration.

Bai Sandra S.A. Sema -v.- Didagen S. Dilangalen  / Lone District of Sharif Kabunsuan with Cotabato City

The Tribunal DISMISSES the instant election protest; AFFIRMS the proclamation of protestee Didagen P. Dilangalen; and DECLARES him to be the duly elected Representative of the Lone District of Shariff Kabunsuan with Cotabato City.

Acting on protestant’s Motion for Reconsideration of the Decision promulgated on September 10, 2009 dismissing, inter alia, the instant election protest, filed on September 22, 2009, as well as on protestee’s Comment/Opposition (to the Motion for Reconsideration of the Protestant) filed on October 2, 2009, and finding the said motion for reconsideration to be bereft of any new issue/argument that has not yet been appropriately resolved in our Decision, the Tribunal DENIES WITH FINALITY said Motion for Reconsideration.

Bai Sandra S.A. Sema -v.- Didagen S. Dilangalen  / Lone District of Sharif Kabunsuan with Cotabato City

The dismissal of the instant case promulgated in the Resolution of the Tribunal dated October 4, 2007 shall become final and executory pursuant to Rule 96 of the 2004 HRET Rules.  Thus, the dismissal herein and the subsequent filing of a new petition for quo warranto do not contemplate a revival of the earlier quo warranto case.

The Tribunal DENIES for lack of merit petitioner’s Motion for Reconsideration.

JOSEPH VIDAR GREY -V.- REYNALDO SANO UY  /  1ST DISTRICT WESTERN SAMAR

The Tribunal GRANTS the Motion to Withdraw Protest filed by protestant on March 9, 2008 and DENIES protestee’s prayer to be allowed to continue and pursue his counter-protest for lack of merit. Accordingly, the Tribunal DISMISSES the protest and counter-protest and CONSIDERS this case close and terminated. The remaining unused cash deposits of the parties shall be released to them after liquidation of expenses for the return of the 490 ballot boxes and election documents to the Commission on Elections.
